By accessing or using Helploom ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Helploom is a customer support platform. Our service includes:

  • Live chat widget for websites
  • Team collaboration tools
  • Email follow-up capabilities
  • AI-powered response suggestions

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription Plans and Billing

4.2 Billing and Payment

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • Payment is processed through LemonSqueezy

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for unused portions of your subscription.

5.1 Permitted Uses

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Use the Service to spam or harass others

5.2 Content Responsibility

You are solely responsible for all content you transmit through our Service, including chat messages, customer data, and any other information. You represent and warrant that you have all necessary rights to such content.

6. Fair Use Policy

While Helploom offers unlimited Live Chat and Help Center features, these are intended for legitimate customer support operations. To ensure fair usage and maintain service quality for all users, we reserve the right to review and take action on accounts that exceed reasonable usage patterns.

6.1 Live Chat

Unlimited Live Chat is provided for genuine customer support conversations. The following uses are considered outside of fair use:

  • Automated or bot-generated conversations that are not part of legitimate customer support
  • Using the chat system for non-support purposes (e.g., general messaging, internal team communication, or as a replacement for other communication tools)
  • Creating excessive conversations through automated means, scripts, or artificial traffic generation
  • Using the service in a manner that degrades performance for other users

6.2 Help Center

Unlimited Help Center is provided for hosting customer support documentation and knowledge base articles. The following uses are considered outside of fair use:

  • Hosting content that is not related to customer support or product documentation
  • Using the Help Center as a content delivery network (CDN) or file hosting service for large media files, downloads, or other non-documentation content
  • Excessive storage usage that significantly exceeds typical knowledge base requirements (e.g., hundreds of gigabytes of content)
  • Generating excessive traffic through automated means, scraping, or artificial load generation

6.3 Enforcement

If we determine that your usage exceeds fair use, we will attempt to contact you to discuss your usage patterns. In most cases, we will provide a warning and work with you to bring usage within reasonable limits. However, we reserve the right to limit, throttle, or suspend accounts that engage in abusive usage patterns or refuse to comply with fair use guidelines after being notified.

6.4 Reasonable Usage

Normal customer support operations, including high-volume support teams handling thousands of legitimate customer conversations per month, or knowledge bases with hundreds of articles and reasonable media assets, are considered within fair use. This policy is designed to prevent abuse, not to limit legitimate high-volume usage.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Helploom and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Service Availability

We strive to maintain high service availability, but we do not guarantee that the Service will be available at all times. We may experience downtime for maintenance, updates, or due to circumstances beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, Helploom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless Helploom and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
